Under HB1105, also known as the Immigration and Nationality Act, our department is required to comply with new mandates from the Georgia Department of Corrections regarding inmates who are not U.S. citizens. This law directs us to track and report specific details about these individuals, including their immigration status, the crimes they’ve committed, and their country of origin. Quarterly reports must be submitted by jail staff, and standardized intake and booking procedures for aliens and foreign nationals are now in effect. Non-compliance carries penalties, and this law overrides any conflicting prior regulations. HB1105 amends Title 42 of the Official Code of Georgia Annotated to enforce these requirements, ensuring consistent monitoring and documentation of non-citizen inmates under our authority.
Georgia Criminal Alien Track and Report Act of 2024
The Georgia Criminal Alien Track and Report Act of 2024 strengthens our department’s role in working with federal immigration authorities to identify and detain illegal aliens involved in criminal activity. Key responsibilities include:
Allowing our officers to verify the immigration status of individuals accused of certain misdemeanors before release on citation.
Requiring our agency to establish formal agreements with federal immigration officials to support immigration law enforcement efforts.
Mandating that we honor immigration detainer notices and provide data on foreign-born inmates in our custody.
Ensuring compliance with state laws, as local governments face penalties for adopting “sanctuary” policies that limit cooperation with federal enforcement.
Additionally, the Department of Audits and Accounts will review annual compliance reports, and DNA sample collection will expand for certain convicted felons under immigration detainers. This bill reinforces our commitment to reducing the presence of criminal illegal aliens in Georgia through enhanced tracking and reporting.
